1. Introduction Welcome to Surfsmith. By using our website and services, you agree to comply with the following Terms & Conditions. These terms govern your use of our website and the purchase and sale of secondhand surfboards, surfboard repairs, and consignment services. Please read them carefully.

2. General Terms 2.1 Surfsmith is an Australian surf shop offering secondhand surfboards, surfboard repairs, and consignment sales. 2.2 We reserve the right to update, modify, or change these Terms & Conditions at any time without prior notice. 2.3 By using our website, you confirm that you are at least 18 years old or have parental/guardian consent.

3. Secondhand Surfboards 3.1 All secondhand surfboards are sold "as is." While we strive to provide accurate descriptions, we do not guarantee the performance, durability, or longevity of any secondhand board. 3.2 No refunds or exchanges are offered on secondhand surfboards unless required under Australian Consumer Law. 3.3 Customers are encouraged to inspect boards in person before purchasing.

4. Consignment Sales 4.1 Surfsmith offers consignment services to assist individuals in selling their surfboards through our store. 4.2 Consignment agreements will outline the minimum price, commission structure, and duration of the consignment period. 4.3 Surfsmith reserves the right to refuse any board for consignment at its discretion. 4.4 Consignors must confirm they are the legal owner of the board and have the right to sell it. 4.5 Payments to consignors will be made within 14 business days of the sale, less any agreed commission or fees. 4.6 Unsold boards must be collected within 14 days of the consignment period ending unless otherwise agreed.

5. Surfboard Repairs 5.1 Repair quotes are estimates and subject to change based on further inspection. 5.2 Turnaround times for repairs may vary depending on workload and complexity. 5.3 We are not responsible for damages occurring after the repair is completed and collected. 5.4 Repaired boards must be collected within 30 days of notification of completion. If not collected within this timeframe, Surfsmith reserves the right to sell the surfboard to recoup the cost of repairs and any associated storage fees.

6. Payments & Pricing 6.1 All prices are listed in Australian Dollars (AUD) and include GST where applicable. 6.2 Payments must be made in full before goods or repaired boards are released to the customer. 6.3 We accept cash, credit/debit cards, and other payment methods as specified on our website.

7. Liability & Warranties 7.1 Surfsmith is not responsible for any injuries, losses, or damages resulting from the use of any secondhand surfboard or repaired item. 7.2 We do not provide warranties on secondhand surfboards beyond those required by Australian Consumer Law. 7.3 Customers acknowledge that surfing involves inherent risks and accept responsibility for their safety.

8. Privacy Policy 8.1 We respect your privacy and handle personal information in accordance with our Privacy Policy. 8.2 By using our website, you consent to the collection and use of your data as outlined in our Privacy Policy.

9. Dispute Resolution 9.1 In the event of a dispute, we encourage customers to contact us first to resolve the issue amicably. 9.2 Any disputes that cannot be resolved will be handled in accordance with Australian Consumer Law and relevant legal frameworks.
